These Terms and Conditions govern the use of the DUDES vs. GRAVITY online store and apply to all purchases made through our website. By accessing our website or placing an order, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you should not use this website or purchase our products.

These Terms and Conditions (“Terms”) govern the use of this website and all purchases made through the online store operated by DUDES vs. GRAVITY d.o.o. (“DVG”, “we”, “us”, “Provider”).

2. Scope and Contract Formation

By placing an order, the customer submits a binding offer to purchase the selected product(s). The contract is concluded when DVG confirms the order via email or dispatches the goods.

These Terms apply to both consumers and business customers. A consumer is any natural person acting for purposes outside their trade, business, or profession. A business customer is any natural or legal person acting in the course of commercial activity.

3. Products

DVG designs and sells climbing training equipment, climbing holds, and related accessories. Products are intended for training purposes only and are not classified as Personal Protective Equipment (PPE).

Due to the natural characteristics of wood and handmade production, variations in texture, color, and finish may occur.

4. Use and Installation Disclaimer

All products must be installed properly and used responsibly. The customer is solely responsible for correct installation, suitable mounting surfaces, and appropriate hardware.

Climbing and training activities involve inherent risks. Users assume full responsibility for safe use. DVG shall not be liable for injuries or damages resulting from improper installation, misuse, negligence, or product modification.

5. Prices and Payment

All prices are stated in EUR and include VAT unless otherwise indicated. Shipping costs are calculated at checkout.

Accepted payment methods include:

  • Credit/Debit cards (via Stripe)
  • PayPal
  • Direct bank transfer
  • Apple Pay
  • Google Pay
  • Klarna

Payment is processed securely through third-party providers. DVG does not store full credit card details.

6. Shipping and Delivery

We ship worldwide. Delivery times are estimates and may vary due to external factors such as customs or courier delays.

For deliveries outside the EU, customs duties and import taxes may apply and are the responsibility of the customer.

7. Right of Withdrawal (Consumers Only)

Consumers have the right to withdraw from the purchase within 30 days of receiving the goods.

Conditions:

  • Products must be unused
  • Returned in original packaging
  • Undamaged and complete

Return shipping costs are borne by the consumer unless the product is defective or incorrectly delivered.

Business customers are not entitled to a statutory right of withdrawal unless otherwise agreed in writing.

8. Digital Products

Digital products (e.g., Lightroom presets) are delivered immediately after payment. By purchasing digital content, the customer expressly agrees that delivery begins immediately and acknowledges that the right of withdrawal is waived once download begins.

9. Warranty

Statutory warranty rights apply in accordance with Slovenian and EU law.

For consumers, mandatory legal warranty rights apply. For business customers, the warranty period is 12 months unless mandatory law provides otherwise.

10. Limitation of Liability

DVG shall be liable without limitation for damages resulting from:

  • Intentional misconduct or gross negligence
  • Injury to life, body, or health
  • Liability under mandatory product liability laws

In cases of slight negligence, DVG shall only be liable for breach of essential contractual obligations and limited to foreseeable damages typical for the contract.

Liability shall in any case be limited to the value of the purchased product.

11. Intellectual Property

All content on this website, including product designs, texts, graphics, images, logos, and trademarks (including GRAVITYboard, OMNI, HELIX, GRAVITYstick and related branding), is protected by intellectual property laws.

Any reproduction, distribution, modification, or commercial use without prior written consent is strictly prohibited.

12. Data Protection

Personal data is processed in accordance with our Privacy Policy, available on our website.

13. Force Majeure

DVG shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to natural disasters, war, strikes, supply chain disruptions, governmental measures, or transportation interruptions.

14. Online Dispute Resolution

In accordance with EU Regulation No. 524/2013, consumers may use the Online Dispute Resolution platform:

DVG is not obliged to participate in alternative dispute resolution proceedings before a consumer arbitration board.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Slovenia. For consumers residing in another EU country, mandatory consumer protection laws of their country of residence remain unaffected.

For business customers, the place of jurisdiction shall be Slovenia.

16. Severability Clause

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Final Provisions

DVG reserves the right to update these Terms at any time. The version valid at the time of purchase shall apply.
